Terms and Conditions

European.realestate (we, us, our) runs european.realestate and the services on it. These terms are between us and you, the person or company using the site or buying a package.

By creating an account, publishing a listing, sending an enquiry or buying a package, you agree to these terms. If you do not agree with them, do not use the site.

You must be at least 18 years old, and you must be able to enter into a contract. If you use the site for a company, you confirm you may bind that company.

Our Privacy Policy explains what we do with personal data and forms part of these terms.

• You give us information that is accurate and complete, and you keep it up to date.
• You keep your password to yourself and you are responsible for what happens through your account. Tell us immediately if you think someone else is using it.
• One account per person or company. You may not let someone else use your account to publish listings, or use an account to work around a limit or a suspension.
• We may suspend or close an account that breaks these terms, that publishes unlawful or misleading content, or that we reasonably believe is being used for fraud. Where we can, we tell you why.
• You can delete your account at any time in your account area. See renewal, cancellation and expiry for what happens to a package you have paid for.

european.realestate is a marketplace. We let owners and estate agents publish property, and we let buyers and renters search it and contact the advertiser. We are not the estate agent, we are not a party to your sale or rental, and we do not own or inspect the properties on the site.

We do not provide legal, tax, valuation, financial or investment advice, and nothing on the site is such advice. A listing is an advertisement placed by its advertiser, and the advertiser is responsible for it.

These rules apply to every listing you publish, whether you type it into the site or send it to us as a feed.

• You have the right to offer the property for sale or for rent, and you are authorised to advertise it.
• The information is accurate, complete and current, including the price, the surface, the property type, the location and the features.
• You own the photos, or you have permission to use them, and they show the property you are advertising.
• The listing is written in English, in ordinary language, and does not use another website's text word for word.
• You keep the listing up to date. When a property is sold, let, withdrawn or its price changes, you change the listing.
• A listing is not a place for content that is unlawful, misleading, discriminatory, or that infringes someone else's rights.

You are responsible for your listing and for the enquiries it brings you. We may remove, shorten or adjust a listing that breaks these rules, that we are told is unlawful, or that damages the quality of the site, and we may limit how many listings an account may publish.

Each listing can carry up to 20 photos. The first photo is the cover.

If you send us your property database as an XML feed, these rules apply on top of the ones above. The technical format is described in the XML Import Specification, which forms part of these terms.

• Your feed is an absolute feed: it must contain all your active properties every time it is generated. A property that is missing from the feed is treated as no longer offered.
• The <id> is the key. Keep it stable for the whole life of a property; we match on it.
• We import your feed automatically, normally once every 24 hours, starting after 01:00 CET.
• A property that disappears from your feed is taken offline after three consecutive syncs. Its data and photos stay in your account, and it comes back online with the next sync if it returns to the feed.
• You keep your feed URL accessible and your images reachable. We download an image once.
• We may pause or disable an import that repeatedly fails, that is missing required fields, or that slows the platform down, and we tell you so you can fix it.

Publishing property is free up to the limit of the free package. Above that you choose a package on the order page. The limits and the current prices are shown there; at the time of writing they are:

• Automatic feed import is included in Starter, Agent and Agency. The Free package does not include an import.
• The free package needs no payment and has no time limit: it covers 3 listings at the same time, and the dashboard stops offering a new one until you take a listing offline or move to a paid package.
• A featured listing puts one listing at the top of the search results and on our homepage. It costs €9.99 per listing.
• An annual package costs less than paying monthly for a year.
• The package starts when the payment is confirmed and runs for the period you chose.
• Prices are in euros. VAT is charged according to your location and your status, and the amount is shown on your invoice.
• Payments are handled by our payment providers, Mollie and WooCommerce Payments. We never see your card number. Every payment produces a numbered invoice, which you can download from your account.
• We may change our prices. A change never affects a period you have already paid for; it takes effect from your next renewal, and we tell you before it does.

• A paid package renews for the same period, monthly or annual, so that your listings stay online without a gap. You can switch the renewal off at any time in your account.
• You cancel yourself, in your account area. There is no need to write to us and no notice period beyond the period you already paid for.
• Cancelling stops the next renewal. Your package runs to the end of the period you paid for, and nothing is charged after that.
• When a package ends, the listings above the free limit stop being displayed. They are not deleted: the data stays in your account, and publishing them again is a matter of renewing.
• An XML import that belongs to a package that has ended is switched off. The settings stay in your account until you delete your profile, and they are removed when you do.
• We send you a reminder before the end date, and a confirmation when you cancel that states what ends and when.

If you are a consumer living in the European Union, you have 14 days after buying a package to withdraw from the purchase without giving a reason. Tell us by email before that period ends and we refund the payment.

One thing to know: a package gives you immediate access to an online service, and we start providing it as soon as you buy it. By buying, you ask us to start straight away, and you accept that if you withdraw after we have started, we may charge you for the part of the period you used. If you have published listings with the package, we deduct the value of what you already used.

This right does not apply to a business customer, and it does not apply to a featured listing once it has been displayed on our homepage.

The content you upload stays yours. To show your listing, we need permission to use it, so by uploading you give us a non-exclusive, worldwide, royalty-free licence to store, reproduce, resize, translate, publish and display it on the site and in the services we run around it, for as long as you keep it with us and for a reasonable period afterwards in caches, backups and search indexes.

You confirm that you have the rights to upload the content you upload, and that it does not infringe anyone's copyright, trademark, privacy or other rights.

You can remove your content at any time by deleting the listing. Copies already made by search engines or by our backups may take a while to disappear.

The site itself — its design, its software, its text, graphics and logos — belongs to us or our licensors and is protected by copyright and other rights. The property listings belong to the people who published them.

You may use the site as a visitor, a user or an advertiser. You may not copy, scrape, or republish a substantial part of our listings or our database, and you may not use automated tools to harvest content or to place load on the site outside the feeds and interfaces we provide. Linking to a page of the site is fine.

Listings and pages can contain links to other websites, and can show content from them, such as a YouTube video or a map. We do not control those sites and we are not responsible for their content or their practices. Visiting them is at your own risk, and their own terms and privacy policy apply.

We keep the site available and secure, but we provide it on an as is and as available basis. We may interrupt it for maintenance, and we do not promise that it is free of faults or that every listing is complete or accurate.

To the extent the law allows, we are not liable for indirect or consequential loss, for lost profit, or for loss that follows from a transaction between a user and an advertiser. Where we are liable, our liability for a package is limited to the amount you paid us for that package in the twelve months before the event.

Nothing in these terms limits liability that cannot be limited by law, including liability for intent, gross negligence, or death and personal injury. As a consumer you always keep the rights the law gives you.

If a third party makes a claim against us because of something you published, or because you did not have the right to publish it, you indemnify us against the reasonable costs of defending that claim and against any amount we are ordered to pay. We tell you about such a claim and let you take part in the defence.

We may suspend an account or an individual listing when we believe these terms are broken, when we must to protect the site or other users, or when the law requires it. Where we can, we tell you what happened and give you the chance to put it right.

We may end the agreement if a serious breach continues, or if we stop offering the service. If we end the service while you have a running package, we refund the unused part.

When the agreement ends, the parts that are meant to keep working stay in force: intellectual property, liability, indemnity, and the governing law below.

These terms are governed by the law of the Netherlands. Disputes are brought before the court of The Hague, unless the law gives you, as a consumer, the right to go to a court where you live.

Before going to court, write to us at info@european.realestate. Most things are solved in one conversation.

We may change these terms when the service, our packages or the law change. The version and date at the top of the page show the current ones, and we tell you in the account or by email before a change that materially affects you takes effect.

A change never affects a period you have already paid for, and it never applies with retroactive effect. If you do not agree with a change, you can cancel before it takes effect.

The property information on european.realestate is published by the advertiser and is shown for information. We do not verify it and we do not guarantee that it is accurate, complete or current.

Properties are offered subject to prior sale, change, rental or withdrawal without notice. Prices, surfaces, features and availability can change between the moment a listing is published and the moment you read it.

Where we show a disclaimer with a listing, that does not make us the author of the listing, and it does not make us a party to the deal. Always confirm the details with the advertiser, and take your own professional advice — legal, financial, tax and valuation — before you decide. We are not responsible for decisions taken on the basis of what you read on the site.

Links from the site to other websites are provided for convenience. We are not responsible for their content or their practices.
